Terms of use

These terms govern your use of distillersexchange.com, app.distillersexchange.com and distillershub.com (the "Service"), operated by C. R. Rajesh Nair, sole proprietor, Goa, India. By using the Service you agree to them. If you use it for a company, you confirm you are authorised to bind that company.

The Service is a business-to-business network for the alcoholic beverages trade. You must be of legal drinking age where you live and use the Service only for lawful business purposes. Alcohol may be bought, sold, imported or exported only by persons holding the licences required by the applicable laws; you are responsible for having them.

We are an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. We provide a directory, messaging, mailboxes and a marketplace. We are not a party to any transaction between members, do not sell or handle alcohol or goods, and do not guarantee the quality, legality, delivery or payment of anything offered. Do your own checks before you trade.

Listings are compiled from public sources and may be incomplete or out of date. Companies may claim, correct or remove their listing free of charge. Regulations pages and news summaries are general information, not legal advice; confirm with the authorities or your advisers before acting.

Post or send anything that is unlawful, false or misleading, infringes anyone's rights, is obscene, defamatory or harassing, impersonates another person or company, contains malware, or is spam or a scam (including advance-fee requests).

Offer goods or services you are not licensed to deal in, or use the Service to evade excise, customs or tax.

Scrape the Service, collect members' data, or attempt to access accounts or systems that are not yours.

These rules are our rules and regulations, privacy policy and user agreement for the purposes of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

You keep ownership of what you post and give us a non-exclusive, royalty-free licence to host, display and transmit it to run the Service. We may screen, refuse, remove or disable content, and suspend or close accounts, that breach these terms or the law, and we act on lawful orders and valid complaints within the times the law requires.

Addresses at distillershub.com are provided to verified companies for business correspondence. They may be suspended for spam or abuse, and end when the company's membership ends.

Basic listing, claiming, messaging and posting are free. If we introduce paid features, we will state the price and terms before you buy.

The Service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, or for loss arising from dealings between members, and our total liability to you is limited to the amount you paid us in the 12 months before the claim (or INR 10,000 if you paid nothing). Nothing limits liability that cannot be limited by law.

These terms are governed by the laws of India. Any dispute arising out of or in connection with them shall be finally resolved by arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Mumbai, the language English. Subject to this, the courts at Mumbai have exclusive jurisdiction, including for interim relief.
